Destination Horizon

Please thoroughly review these terms and conditions of Destination Horizon Travel Agency. The booking passenger, by accepting this receipt and making payment to Destination Horizon Travel Agency, acknowledges that they have been advised of, reviewed, and hereby accept these terms and conditions and contract for travel related services, as well as authorizing Destination Horizon Travel Agency and/or the supplier of your trip to charge your credit card the authorized amount. These conditions apply to yourself, your family or traveling companions that you represent or make payments on their behalf.
 

Destination Horizon Travel Agency offers retail travel services to customers, which are provided by separate and independent vendors of travel services. We do not operate, control, or otherwise provide the services of the independent travel vendors. Destination Horizon Travel Agency acts only as a sales agent for any airline, hotel, car-rental company, ground operator, tour operator, cruise line, shore excursion, attractions, or other travel Suppliers who provide goods or services for the passenger(s) trip. When agreeing to Destination Horizon Travel Agency’s terms and conditions, you are also agreeing to the terms and conditions of the Supplier. 

 
 

TERMS AND CONDITIONS:


 

TRAVEL DOCUMENTS: Travel documents include, without limitation, airline tickets, hotel vouchers, tour vouchers, or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates, and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates, and timings on your documentation will be your responsibility if we are not advised at the time of booking. Please reconfirm your flights at least 24 hours prior to departure. If minors are involved, it is your responsibility to have proper permission for the minor to travel. 

 

PASSPORTS: All individuals departing from the United States of America must be in possession of a valid passport. Please check that your passport is valid for at least 6 months beyond your intended travel time. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State or the representative government agency of the country to which you are traveling to confirm the requirements for visas and/or other requirements for admission to your destination. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility.

 

FORCE MAJEURE: “Force Majeure” means, in relation to DESTINATION HORIZON TRAVEL AGENCY, any circumstances beyond the reasonable control of DESTINATION HORIZON TRAVEL AGENCY, (including, but without limitation, acts of God, explosion, flood, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences). DESTINATION HORIZON TRAVEL AGENCY shall not be liable for any loss or damage incurred by you as a consequence of any of the Suppliers being unable to perform its obligations due to the unusual or unforeseeable circumstances (a “force majeure event”) beyond the control of the party affected by the force majeure event. DESTINATION HORIZON TRAVEL AGENCY is not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, DESTINATION HORIZON TRAVEL AGENCY is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services, whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or any failure of any transportation mechanism to arrive or depart on time. Also be advised that certain foreign facilities or amenities, such as air-conditioning systems in public places, hotels, and motor coaches may not be up to U.S. standards. If due to weather, flight schedules, or other uncontrollable factors you are required to spend additional night(s), you will be responsible for your own hotel, transfers, and meal costs. Baggage is entirely at owner's risk. The prices of these tours are based on rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. You specifically agree that DESTINATION HORIZON TRAVEL AGENCY is not liable for any consequential loss or damage.

 

REFUNDS AND CANCELLATIONS: Please be aware that most travel bookings are non-refundable and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking that you cancel, you agree to indemnify us for the amount of that fee or charge. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you may be bound by those contracts regardless of whether you receive notice of their terms. Pricing and availability may change without notice. In the case of an airline e-ticket being issued, it is your responsibility to understand your e-ticket’s expiration policy which is unique to the individual airline. Passenger(s) agrees that DESTINATION HORIZON TRAVEL AGENCY is not responsible for any errors or omissions in any quotes, advertisements, including on our website, resulting in inventory, content, or pricing discrepancies nor is DESTINATION HORIZON TRAVEL AGENCY responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold DESTINATION HORIZON TRAVEL AGENCY harmless for any actions or damages arising from Supplier pricing.

 

APPLICABLE FEES (CHANGE FEES; REQUOTE FEES): 

 

Change Fees: Once a travel booking has been confirmed and deposit(s) and/or full payment received, DESTINATION HORIZON TRAVEL AGENCY reserves the right to charge a $50 non-refundable, non-negotiable change fee made at your request for each adult travel booking changed. This Change Fee is in addition to any change fees charged by the travel service provider(s). 

 

Requote Fees: DESTINATION HORIZON TRAVEL AGENCY may charge a non-refundable, non-negotiable “requote fee” when revising or updating a previously provided travel itinerary. This amendment could arise due to various factors: fluctuating airfare, accommodation availability, or client-requested modifications. The requote fee is applicable in scenarios where alterations to the original itinerary are requested by the client after its initial formulation by DESTINATION HORIZON TRAVEL AGENCY. The quantity of the requote fee is determined by DESTINATION HORIZON TRAVEL AGENCY and is subject to change without prior notice. The fee may vary based on factors such as the extent of changes, time sensitivity, and prevailing market conditions. Clients are advised to consult with DESTINATION HORIZON TRAVEL AGENCY to ascertain the applicable requote fee for their specific circumstances. 

 

Minor adjustments to the itinerary, such as date modifications within a specified window, may incur lower requote fees and can range from $10-$25.

 

Comprehensive itinerary overhauls necessitating extensive research and coordination may entail higher requote fees and can range from $35-75.

 

Requotes requested on an expedited basis, particularly for imminent travel, may be subject to higher fees due to the urgency of real-time adjustment and can range from $75-$125.

 

DESTINATION HORIZON TRAVEL AGENCY reserves the right to waive requote fees at its discretion, particularly for minor adjustments or under specific promotional offers. Clients are encouraged to inquire about potential waivers based on their circumstances and the prevailing policies of DESTINATION HORIZON TRAVEL AGENCY. Clients are encouraged to communicate their preferences, budget constraints, and expectations clearly during the initial consultation to minimize the need for subsequent requests. Transparent communication facilitates a collaborative client-agency relationship and enables DESTINATION HORIZON TRAVEL AGENCY to tailor the itinerary efficiently. Requote fees are billed to the client prior to receipt of the revised itinerary. Payment of requote fees is subject to the prevailing billing and payment terms of DESTINATION HORIZON TRAVEL AGENCY.

 

HAZARDOUS MATERIALS ADVISORY: It is your responsibility to become familiar with the Hazardous Materials Advisory, and to comply with these advisories. You can find more information at faa.gov: What are Dangerous Goods? | Federal Aviation Administration (faa.gov)

 

REFUSAL OF SERVICE: Service providers reserve the right to refuse service to travelers at their sole discretion, including, without limitation, if the traveler: (i) Lacks proper documentation for the country of destination; (ii) Has a contagious disease; (iii) Is under the influence of alcohol, drugs, or narcotics; and/or (iv) Manifests disruptive and/or unruly behavior. DESTINATION HORIZON TRAVEL AGENCY assumes no liability for the acts of the service provider in refusing service.


HOURS OF SERVICE: "Business hours" refers to the operational hours during which DESTINATION HORIZON TRAVEL AGENCY provides our goods or services and conducts our business activities. Standard business hours are Monday to Friday from 8:00am CST to 5:00pm CST. There may be exceptions to the standard business hours during holidays, special events, or unforeseen circumstances. DESTINATION HORIZON TRAVEL AGENCY aims to respond to customer inquiries and support requests during business hours within a reasonable timeframe. However, response times may vary depending on the nature and complexity of the inquiry. While DESTINATION HORIZON TRAVEL AGENCY primarily operates during standard business hours, we may offer after-hours support for emergency and/or urgent matters. After-hours support availability, contact methods, and response times will be communicated separately, if applicable. Clients are responsible for familiarizing themselves with DESTINATION HORIZON TRAVEL AGENCY'S business hours and any updates or changes communicated by the company. It is recommended that customers plan their interactions or transactions with us accordingly, taking into account the specified business hours.


 Furthermore, DESTINATION HORIZON TRAVEL AGENCY's suppliers also operate under standard business hours and, while we will do the best to our abilities to communicate with our suppliers, we may be limited by our supplier's business hours.

 

AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN: Your airline ticket is a contract between you and the air carrier, even if you purchase through DESTINATION HORIZON TRAVEL AGENCY. If you purchase air travel through DESTINATION HORIZON TRAVEL AGENCY, you acknowledge and agree that DESTINATION HORIZON TRAVEL AGENCY does not have the right to control the operations of independent airlines, and agree that DESTINATION HORIZON TRAVEL AGENCY is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations.

 

You understand and agree that DESTINATION HORIZON TRAVEL AGENCY functions solely and exclusively as a booking agent for the air carrier, that we do not handle or hold client funds for airline tickets, and that we are not the Merchant of Record under the meaning of that term under the Department of Transportation's regulations. Because DESTINATION HORIZON TRAVEL AGENCY does not hold or handle client funds, you understand and agree that any refund for cancelled or delayed flights, baggage fees or seat assignments must come directly from the airline and not from DESTINATION HORIZON TRAVEL AGENCY.

 

DESTINATION HORIZON TRAVEL AGENCY shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise.

 

Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.

 

Frequent Flyer mileage accrual is at the discretion of the airline(s). DESTINATION HORIZON TRAVEL AGENCY has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status or certificates.

 

Seat assignments are not guaranteed even after they are assigned, and DESTINATION HORIZON TRAVEL AGENCY has no control over airline seat assignments. Most airlines charge a fee to pre-book a seat.

 

We strongly suggest that clients reconfirm exact flight times with the carrier prior to departure. Air travelers are required to check in at least 2 hours prior to departure time for domestic flights and 3 hours for international flights and must report to the gate at least 30 minutes prior to departure time. Failure to comply may result in the loss of the seat to another passenger. 

 

INTERNATIONAL FLIGHTS: Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Federal law requires that we refer you to the Department of Transport disinfection website. (www.transportation.gov/airconsumer/spray).

 

LIABILITY: DESTINATION HORIZON TRAVEL AGENCY is not responsible for missed connections, schedule changes, aircraft changes, or trip interruption. It is the traveler’s responsibility to have proper travel documents for all trips including but not limited to vouchers, passports, visas, marriage licenses, or birth certificates. Travel insurance should be purchased to protect you in these circumstances. Change and cancel fees may apply. Hotel and tour operator fees may apply at the time of a change or cancellation of existing schedule. PLEASE NOTE: all rates are subject to change without notice until deposit is made. 


RISKS/SAFETY: Travel to certain destinations may involve greater risk than others. DESTINATION HORIZON TRAVEL AGENCY urges customers to remain informed as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, and www.cbp.gov

 

By offering for sale travel to particular destinations, DESTINATION HORIZON TRAVEL AGENCY does not represent or warrant that travel to such points is advisable or without risk, and shall not be liable for costs, damages, or losses that may result from travel to such destinations. customer’s participation constitutes acceptance of such events at customer’s own risk. It is your responsibility to understand and comply with the vaccinations and health screenings required for your destination. 

 

INDIVIDUAL ENTRY AND EXIT REQUIREMENTS: Each foreign country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or past offense, and you are unsure how the country you are traveling to (or through) views that offense, please contact that country directly for entry and exit requirements. (See:travel.state.gov/travel/cis_pa_tw/cis/cis_4965.html) DESTINATION HORIZON TRAVEL AGENCY feels it is an invasion of privacy for any member of our staff to make such an inquiry. For example, if traveling to or through Canada, Americans with a Driving While Intoxicated (DWI) record should always check whether current rules exclude admission, and potential waivers. SUPPLIER INFORMATION: While DESTINATION HORIZON TRAVEL AGENCY prides itself on selecting top quality Suppliers, we assume no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under our control. Suppliers reserve the right to deviate from the direct, customary and/or scheduled route or itinerary for any reason, without limitation and without notice. Passenger(s) acknowledge and agree that DESTINATION HORIZON TRAVEL AGENCY is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections or any other condition beyond its control.


 We will inform you as soon as reasonably possible if a Supplier needs to make a significant change to your confirmed booking or to cancel. We will also liaise between you and the Supplier in relation to any alternative arrangements offered by the Supplier, but we will have no further liability to you. If the Supplier is unable to offer agreeable alternative services, we will work to obtain and secure an alternate supplier for your travel. We are not responsible for a supplier’s failure to pay a refund or for supplier bankruptcy or insolvency or inability to perform.

 

TRAVEL INSURANCE: Travel insurance protection is always strongly recommended. As your travel agent, we have a professional responsibility to recommend the purchase of travel insurance to cover certain risks inherent in travel to protect against THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES. By declining appropriate travel insurance, passenger(s) acknowledges and accepts liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred.

Please note that the travel insurance provider may not be allowed to discuss your claim with DESTINATION HORIZON TRAVEL AGENCY due to privacy laws (e.g. HIPAA). Passenger(s) acknowledge and agree that DESTINATION HORIZON TRAVEL AGENCY has no control over the travel insurance provider or its coverage decisions, and as a result, DESTINATION HORIZON TRAVEL AGENCY is not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.

 

ELECTRONIC OR HANDWRITTEN SIGNATURE: Both parties agree that you may acknowledge and agree to these Terms: (i) electronically; (ii) by handwritten signature; (iii) by any other electronic means, including, without limitation, via email acceptance of these Terms; or (iv) by your implied consent deemed via your actions, which shall include without limitation the payment of the invoice and/or your use of the services provided by DESTINATION HORIZON TRAVEL AGENCY or any other travel supplier related to your booking. All such means will be deemed to constitute effective acknowledgement and execution of this Agreement and shall be sufficient to bind the parties to the terms and conditions of this Agreement.
